Marble Portal Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Marble Health Portal (the “Portal”), which is operated by Marble Health, Inc. and any entity to which it provides administrative services (collectively, “Marble,” “we,” “us,” or “our”). The Portal is accessible via web browser on desktop and mobile devices.
By creating an account, accessing, or using the Portal, you agree to be bound by these Terms. If you do not agree, do not access or use the Portal.
1. Overview of the Portal
The Marble Portal is a web-based platform used to support the delivery, coordination, and administration of behavioral health services. The Portal supports multiple user types, including:
- School-Based Users (e.g., school counselors, administrators, or other designated staff)
- Families and Caregivers (including parents, guardians, and, where permitted by law, patients)
- Therapists and Clinical Providers
Access, features, and permissions vary by user type and are governed by these Terms, applicable law, and any additional agreements between you and Marble.
2. Eligibility and Account Registration
You may only create an account and use the Portal if:
- You are legally able to enter into a binding agreement (NOTE: Individuals under thirteen (13) years of age are prohibited from using the Portal); and
- You are authorized to access the Portal in your designated role (e.g., as a family member, school-based user, or therapist).
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify Marble immediately of any unauthorized access or use of your account.
3. User-Specific Terms
3.1 School-Based Users
School-based users may access certain student information only where Marble has received a valid, signed authorization from a parent, legal guardian, or other authorized individual, as required by applicable law.
School-based users agree that they:
- Will access student information solely for permitted educational or care-coordination purposes;
- Will comply with all applicable privacy laws and regulations, including but not limited to FERPA and any applicable state laws;
- Will not disclose, copy, or use student information outside the scope of the authorization provided.
Access may be limited, modified, or revoked at any time based on authorization status, role changes, or compliance concerns.
3.2 Families and Caregivers
Family members and caregivers may be authorized to use the Portal if they are legal guardians of a patient of a provider using Marble or are otherwise legally authorized personal representatives. Family users may use the Portal to manage aspects of care, including but not limited to:
- Scheduling or requesting appointments;
- Completing intake forms or assessments;
- Viewing information related to services provided by Marble;
- Communicating with Marble, where enabled.
Families acknowledge that:
- The Portal is not intended for emergency use;
- Information presented in the Portal may not be real-time or comprehensive;
- Certain features or access may change based on the patient’s age, consent status, or applicable law.
3.3 Therapists and Clinical Providers
Therapists may use the Portal as a clinical documentation and care-management tool.
Therapists agree that they:
- Are solely responsible for the accuracy, completeness, and timeliness of all clinical documentation they enter;
- Will use the Portal in compliance with all applicable professional, ethical, and legal obligations (including but not limited to HIPAA, state licensing and privacy law, and their contract as a provider on the Marble platform);
- Will maintain required licensure, certifications, and authorizations;
- Understand that the Portal is a tool and does not replace professional judgment or legal responsibility.
Additional contractual terms may apply to therapists pursuant to separate agreements with Marble.
4. Privacy and Health Information
Marble’s collection, use, and disclosure of information—including protected health information (PHI)—is governed by our Notice of Privacy Practices and by law, including HIPAA, where applicable.
By using the Portal, you acknowledge that:
- Certain information may be shared among authorized users consistent with signed releases, consents, and applicable law;
- Electronic communications may have inherent security risks, despite reasonable safeguards;
- You are responsible for maintaining the privacy of information accessed through your account. If you are a patient who chooses to exchange information via unencrypted means (e.g., text message or email), you acknowledge that using those means present a higher risk that the data may be intercepted.
5. Acceptable Use
You agree not to:
- Use the Portal for any unlawful, unauthorized, or fraudulent purpose;
- Access or attempt to access data or accounts not intended for you;
- Interfere with or disrupt the operation or security of the Portal;
- Upload or transmit malicious code, viruses, or harmful content;
- Misrepresent your identity or role.
Marble may investigate and take appropriate action for violations of this section.
6. Availability and Modifications
The Portal is provided on an “as-is” and “as-available” basis. Marble does not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue any part of the Portal at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Portal after updated Terms are posted constitutes acceptance of the revised Terms.
7. Intellectual Property
All Portal software, content, and materials on the Portal are owned by or licensed to Marble and are protected by intellectual property laws. To the extent you provide any feedback related to any of the foregoing, you hereby assign to Marble all right, title and interest to such feedback, and if for any reason such assignment is ineffective, you agree to grant Marble a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such feedback without restriction.
You are granted a limited, non-exclusive, non-transferable right to access and use the Portal solely for its intended purposes.
8. Termination
Marble may suspend or terminate your access to the Portal at any time, with or without notice, for any reason, including violation of these Terms, lack of authorization, or legal or compliance requirements.
Upon termination, your right to access and use the Portal will immediately cease.
9. Disclaimers
THE PORTAL DOES NOT PROVIDE MEDICAL ADVICE OR EMERGENCY SERVICES. IN CASE OF AN EMERGENCY, CALL 911 OR LOCAL EMERGENCY SERVICES.
MARBLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Limitation of Liability
To the fullest extent permitted by law, Marble shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Portal. Marble’s maximum liability under these Terms shall be the lesser of your actual damages or one hundred dollars ($100.00).
11. Indemnification
You agree to indemnify and hold harmless Marble from any claims, damages, losses, or expenses arising from your activity on the Portal, violation of these Terms, or violation of applicable law.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the state of New York, without regard to conflict-of-laws principles.
